3. You have not previously been suspended or removed from the Services;

5. You are not a competitor of ours and are not using the Services for reasons related to competition with us or for a purpose other than ours;
6. You are not in, controlled by, or a national or resident of any country that is (i) embargoed by the United States, (ii) designated as a Specially Designated National, or (iii) placed on the Table rejected orders of the Ministry of Trade.

The team of our Service checks the information about the user (age and other identifying data) themselves, and may involve third parties for this. In case of negative results of checking the information about the user, such user will be prohibited from further posting content and using Service.

When you create an account on the Website, you are responsible for the security of your own account, and you are fully responsible for all activities that occur under the account. Our Website has the right, but not the obligation, to monitor and review newly created accounts before you can use our Services. In cases where you provide any false (incorrect) contact information, this may lead to the termination of your account on our Service. In the event of any unauthorized use of your account or breach of security, you must notify us immediately. You are solely responsible for the content and information that you provide, post, display or otherwise communicate to us through the Service or to other users (collectively "Postings"), including, messages, data, text, photos, videos, music, graphics , links or other materials posted in chat messages, community pages, photos and profile information ("User Content"). Our Company has no control over, and assumes no responsibility for, any User Content posted by you or any third party on the Website, or for any loss or damage thereof. In addition, our company also assumes no responsibility for any errors, defamation, omissions, misrepresentations, obscenity, pornography or profanity that you encounter. By submitting or posting User Content, you hereby grant us a royalty-free license to use, copy, publicly perform, publicly display, reproduce, adapt, modify, distribute, publish, list information with respect to such User Content. You represent and warrant that User Content, and the Company's public posting and use of Your User Content, will not infringe any right of any third party, including, without limitation, any intellectual property right or right of privacy or publicity, and will not any harm to any third party or violate the terms of this Agreement. You further represent and warrant that you have the written consent of each individual identifiable in your User Content to use such individual's name, voice, or likeness in the manner contemplated by this Agreement, and each such individual has released you from any liability that may arise in connection with such use. By posting User Content, you hereby release us from any claim that such use as set forth above infringes any of your rights, and you understand that you will not be entitled to any additional compensation for your user use.
5. Use of confidential information of other persons. You agree not to publish, copy, transmit, create any derivative works of, distribute, reproduce or display in any way any copyrighted, trademarked or other proprietary information or material, including any User Content, published by other users, without the prior consent of the owner. You acknowledge that information or materials available through the Service may be copyrighted, whether or not designated as copyrighted.

6. Prohibited content. You agree not to post, transmit or deliver to any other user, directly or indirectly, any User Content that is prohibited by this Agreement or any other Company policy ("Prohibited Content"). Prohibited Content includes User Content that:

   • fraudulent or illegal;
   • promotes racism, bigotry, hatred or any physical harm to any group or person;
   • is intended to harass or intimidate any other user or third party or does so;
   • may infringe or infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party, including User Content that contains copyrighted content of others (eg photos, images, music, movies , video, ) without obtaining proper permission;
   • contains images or any information that may promote human trafficking, sex trafficking or physical violence;
   • encourages or facilitates criminal or illegal activity, such as instructions for the manufacture or purchase of weapons or drugs;
   • contains viruses, trojans, cancel bots, worms or other harmful or destructive code, components or devices;
   • is, in the Company's sole opinion, objectionable or restricts or inhibits any person from using or enjoying the Services or exposes the Company or its users to harm or liability.

   In case of disagreement with us regarding the classification of the user's content as prohibited, such user has the right to submit a justified appeal to the support service of the Website. Based on the results of the review, the user is sent a response about the approval or rejection of the appeal.

7. Pornographic or sexual content. Residents of countries that allow posting of pornographic content have the right to post such content on our Service, but only subject to the following restrictions and prohibitions:

   • the prohibition of posting child pornography (anyone under the age of majority - 18 or 19 years depending on the legislation of the country of residence), in particular the image or description of such persons, also if the word "teenager" is used in your content, this must be clearly and prominently indicated that such a person has reached the age of majority.
   • the prohibition of posting forced sexual acts without consent, in particular: oral, anal or vaginal penetration through the genitals, an object (diluted, strap-on, etc.) or fingers and contains wording or actions that indicate a lack of consent: rape, force, in a dream, drugged, passed out/blacked out, chloroform, unconscious, hypnotized, drunk, inebriated, inebriated, drugged sex, dumping, etc. Someone who is drunk, asleep, hypnotized, etc. cannot give consent and therefore qualifies as a violation.
   • prohibition of posting acts of zoophilia, in particular content that depicts or describes sex with animals and actions with non-human beings (aliens, mythological creatures, etc.).

   • prohibition of posting actions containing violence or extreme sexual violence and/or pain.

   Residents of countries that prohibit the distribution of pornographic or sexual content are prohibited from posting such content on our Service.

8. Prohibition of Prostitution and Sex Trafficking

   • Scope of Prohibition: The use of our Website and its interactive services is strictly prohibited for any activities related to prostitution or sex trafficking. This includes, but is not limited to, engaging in, participating in, supporting, promoting, soliciting, or facilitating the prostitution of another person or sex trafficking.

Upon verification of such activities, we will take appropriate action, which may include, but is not limited to, terminating the accounts of users involved in prostitution or sex trafficking.
   • Cooperation with Law Enforcement: We will report any individuals suspected of promoting, facilitating, or engaging in prostitution or sex trafficking to the appropriate law enforcement agencies. We are committed to cooperating fully with law enforcement in any investigations related to these activities.
   • Zero Tolerance Policy: We maintain a zero-tolerance policy towards prostitution and sex trafficking. Any user found to be in violation of this policy will face immediate account termination and potential legal consequences.
   • User Responsibility: All users are responsible for their conduct on the Website and must adhere to these terms. Ignorance of this policy will not be considered an excuse for violating it.
   • Updates to Terms: These terms are subject to change at any time, and users are encouraged to review them periodically. Continued use of the Website after changes to the terms constitutes acceptance of the new terms.

If you use our Service through a third-party social network or similar site, mobile or other application ("Social Network Site"), such as Google or Twitter, you allow us to access certain information about you that is provided to the Company through or from that social network site. network The information received by the Company depends on the social networking site and may include information such as your name, profile picture, network, gender, username, user ID, age range or birthday, language, location, country, interests , a list of contacts, lists of friends or followers, and more. Content Review & Removal

• The user is solely responsible for the Content posted on the Service.
• All the User Content is reviewed before the publication by our moderation team.
• If the user violates the rules for posting content, the Service reserves the right to remove the content and/or report this to the relevant law enforcement authorities.

Identity Verification Policy

1. Before a user can post content on our website, they must complete a two-step verification process:

   • Get verified by Veriff verification service.
   • Get verified by our moderation team.

2. To start identity verification a user must be at least 18 years of age and must have reached the age of majority in their respective location, adhering to the requirement that all users must be of legal age

3. Users can only post photos and videos and other materials featuring themselves without obtaining prior consent. If the uploaded content includes other individuals, it must comply with the following conditions:

   • All individuals must be mentioned during the publication.
   • Individuals should have an account on RichSubs and should have successfully completed the identity verification process.
   • Each individual should explicitly give consent for publication by responding to the registered email from RichSubs Team before the content goes live.

Payouts Policy

• Standard Fee: RichSubs applies a standard fee of 20% on all payouts to Content Creators. This fee is deducted from the total amount earned.
• Discounts on Fees: In certain cases, Content Creators may be eligible for discounts on the standard payout fee. These discounts are applied based on specific criteria or promotions and will be reflected in your account accordingly.
• Refund Policy: Please note that any earnings accumulated within this 14-day window are subject to refunds. This means that the amount available for payout may vary if any transactions are refunded during this period.
• Payout processing period: We have standard 7-day payout period for all incomes.
• Payout Availability: Earnings are eligible for payout after a Payout processing period. This waiting period is necessary to ensure all transactions are finalized and to manage refunds effectively.
• Payout Schedule: Once the Payout processing period has elapsed, and assuming no refunds have been processed, the remaining balance after the standard fee deduction will be available for payout according to your chosen payout method.
• Referral Program: We offer a referral program that includes exclusive bonuses.
  • For the next 50 days, no standard fee will be charged on withdrawals made by the Creator from purchases by Subscribers who joined through the Creator’s referral link.
  • The Creator will receive a 5% commission on all purchases made by Subscribers invited by the Creator’s referral.
  • The Creator will earn a 5% commission on all earnings of other Creators who joined through the Creator’s referral link.

• Account Review: We regularly review accounts for compliance with our Terms of Service. Any discrepancies or violations may affect the availability of payouts.
• Please ensure you keep your account information up to date to avoid any delays in receiving your payouts.

Return policy

Legally, any funds expended are considered a gratuity on out Website. Nonetheless, in accordance with our Chargeback and Fraud Policy, should a user seek a reimbursement, we will provide one to prevent any potential chargebacks.

We can refund:

• The remaining balance topped up using a credit card, with no time limit on the eligibility for a refund.
• Any other purchases made within the last 14 days.

Complaints resolution

If you have a complaint about our Service (including any complaint about Content appearing on RichSubs or the conduct of a User), please send your complaint to support@richsubs.com including your name, address, contact details, a description of your complaint and, if your complaint relates to Content, the URL for the Content to which your complaint relates.

If you have a complaint about specific User Content, you can submit a report using our report submission form.

Following receipt of your complaint of illegal or non-consensual Content:

• we will take such steps as we consider to be appropriate to investigate your complaint within a timescale which is appropriate to the nature of your complaint;
• if we require further information or documents from you, we will contact you to let you know;
• we will in good faith investigate your complaint within seven (7) business days;
• if we are satisfied that the Content is unlawful or non-consensual, we will immediately remove such Content, and we will notify you of our decision by email or other electronic message;
• if we are satisfied that the Content is not unlawful or non-consensual, we will notify you of our decision by email or other electronic message.

Any dispute regarding our determination that Content is non-consensual will be submitted by us to a neutral arbitration association at our expense.

If you are a User of our Service, you warrant that you will not make any complaint which is wholly unjustified, abusive, or made in bad faith. If we determine that you have breached this warranty, we may suspend or terminate your User account.

Dispute resolution

If you have a dispute or misunderstanding regarding the Service, you agree to first try to resolve the dispute informally by contacting the Company. In case of impossibility of resolving the dispute informally, the Company may offer to resolve the dispute with the help of mediation or arbitration, after which the user may apply for resolution of the dispute to the court of the country of which he is a resident.

If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you reside.

Compliance with US law

You represent and warrant that

1. you are not located in a country that is subject to a United States government embargo or that has been designated by the United States government as a “terrorist supporting” country;
2. you are not listed on any United States government list of prohibited or restricted parties.

Chargeback-Fraud Policy

• In addressing concerns from our subscribers, we proactively address complaints by offering refunds upon request to minimize chargebacks.
• We diligently examine reports related to both subscribers and content creators to assess whether the transactions associated with their accounts exhibit an unusually high chargeback or fraud ratio. If we identify instances of excessively high chargebacks or fraud ratios, we reserve the right to terminate the User Account.
• Additionally, as a preventive measure, we conduct an Address Verification System (AVS) check on customer transactions. For high-value transactions, we implement careful monitoring to ensure there is no unauthorized access to the account, and we may initiate manual outreach to end users.

Restrictions on use

You are granted the right to use our Service only for lawful purposes and in accordance with applicable law, it is strictly prohibited to store, distribute or transmit any illegal materials using our Service. We warn you that any transmission, distribution or storage of illegal materials or use of our Service for illegal purposes may subject you to criminal or civil liability, termination or suspension of these Terms, your Account and use of the Services, and removal of your Content.

Backups of the Website and Content

We make backup copies of the Website and Content for our own administrative purposes, but these backup copies are not guaranteed in any way. You are responsible for keeping your own backup copies of your data. We do not provide any compensation for lost or incomplete data in case the backup does not work properly. We will do our best to ensure a complete and accurate backup, including your data, but we are not responsible for this obligation.

We are not responsible for the actions, products, services or content of any other third parties. There are no third party beneficiaries to this Agreement, and no third party that is not a party to this Agreement shall have the right to enforce any term of this Agreement. Security and support

We cannot guarantee that the Service will always operate without delays, errors or failures because we do not control the third-party networks through which our Service is provided. We make every effort to make our Service safe for all users.

Our Service may need updating or refinement. To do so, we may temporarily suspend or limit your use of the Service. Please note that you will not be entitled to claim damages for such restriction of use.

Attention, you are prohibited from using our Service to violate security or interfere with system resources and/or accounts. The use or distribution of tools designed to compromise security (eg password pickers, hacking tools) is strictly prohibited. If you are involved in any breach of system security, we reserve the right to provide your information to system administrators of other sites, law enforcement and/or government authorities to assist them in resolving security incidents.
